Missed Your Commercial Lease Renewal Deadline in South Australia?
Does your landlord have to remind you to renew your commercial lease? Generally, a tenant must exercise an existing option to renew within the timeframe and in the manner specified by the lease. A landlord is not automatically required to remind the tenant, although statutory notification duties can arise in particular circumstances.
What happens if you miss the option to renew?
Missing the contractual deadline may mean losing the right to require a renewal on the terms of the existing option. That does not necessarily prevent the landlord and tenant from agreeing to a new lease or another arrangement. The wording of the lease, any communications and the circumstances matter.
Does the landlord have to give a renewal reminder in SA?
Not automatically. Certain leases covered by the Retail and Commercial Leases Act 1995 (SA) may attract specific statutory notice or renewal protections, but those provisions do not apply to every lease and do not automatically revive a missed contractual option.
Five practical steps after missing a lease renewal deadline
- Find the lease: review the option clause, deadline, notice address and required method of service.
- Check the communications: locate emails, letters and notices that may relate to renewal.
- Confirm the legal position: check whether the lease and applicable legislation provide any relevant rights.
- Discuss renewal: consider negotiating with the landlord without assuming that the original option remains enforceable.
- Review proposed terms: obtain advice before accepting new rent, guarantees, outgoings or other obligations.
Frequently asked questions
Can I renew my commercial lease after the deadline?
You may still be able to negotiate a renewal or new lease. Whether you can insist on renewal depends on your lease and circumstances.
Can my landlord increase the rent if I miss my option?
If the contractual option has expired, the landlord may propose different terms for a new lease. Whether those terms are lawful and negotiable depends on the applicable lease and legislation.
Does the Retail and Commercial Leases Act protect every tenant?
No. Coverage and particular protections depend on the premises, lease and statutory requirements.
Should I sign the new lease immediately?
Have the terms and your existing rights reviewed before signing, particularly if the proposal changes rent or liabilities.
